This Privacy Policy applies to all personal information collected by 4MySay Pty Ltd ACN 656 506 231 (“4MySay.online”) via the website located at 4MySay.online

How we collect your personal information

We may collect personal information from you whenever you input such information into our website. 

We also collect cookies from your computer which enable us to tell when you use the website and also to help customise your website experience. As a general rule, it is not possible to identify you personally from our use of cookies or the data we collect at registitration.

Access and correction

Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. Purpose and Use of your Information

By using our website you consent to 4MySay.online providing the way you have voted and the demographics associated with your vote for the purpose of providing third parties be they businesses, governments or other recipients to further benefit and guide policy, decision making and any other reasonable purpose. 

 

Your email address will only be used for the purpose for which you have provided it and it will not be added to a mailing list or used for any other purpose without your consent.

 

We will not use or disclose information collected about you other than for a purpose made known to you, a purpose you would reasonably expect, a purpose required, authorised or permitted by or under any law, or a purpose otherwise authorised by you.

 

How we disclose your information

4MySay.online only discloses your information in very limited circumstances and, when it does so, it only provides parts of your information that are necessary for the recipient’s purposes.  This will generally only occur in the following situations: Year of Birth, Gender, How you Identify , Ethnicity, Income, and your Post code. 4MySay.online shall not ever, under any circumstances deliberately release your email address, phone number, or how you voted on any subject. 4MySay does not require your name.

 

We do not, under any circumstances, sell or otherwise trade in your personal information, except in the information detailed in the previous paragraph.  Generally, 4MySay.online will not disclose your personal information to any of its contractors or service providers.  However, circumstances may arise where this is necessary at some point in the future.  Should such circumstances arise, we will ensure that strict contractual measures are in place requiring the recipient to protect the privacy of your information, to use the information only for the purposes of its engagement, and to destroy any copies of the information once its engagement is complete.

We may also disclose a person’s personal information where it is expressly permitted under the Privacy Act; for example, where we are legally required to do so (such as under a court order) or where the Police inform us that they are investigating a particular individual and request information from us about that individual to assist them with their inquiries (in which case we will only provide details after making a record of the names and badge numbers of the police officers to whom the information is provided).

 

How we secure your information

We hold all of your personal information in a secure manner to ensure that it is protected from unauthorised access, modification and disclosure.

Our electronic databases are stored on a central server in a secure location which provides top-level physical security.

Security measures regarding electronic records meet highest industry standards and include 1024 bit and 128 bit encryption, usernames and passwords, firewalls and audit-trails. Access to electronic records is strictly limited to staff whose tasks require access.

When records containing personal information are no longer needed, we ensure those records are destroyed securely; for example, we degauss (ie. demagnetise) electronic records so that information contained in them cannot be retrieved.

 

Complaint procedure

If you have a complaint concerning the manner in which we maintain the privacy of your personal information, please contact us as set out below. All complaints will be considered by our privacy officer and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. 

If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner. However, under the Privacy Act, you can only lodge a complaint with the Commissioner if you have first lodged your complaint with us.  This is so that we have an opportunity to resolve your concern directly before it is raised with the Commissioner. Overseas transfer

Your personal information may be transferred overseas or stored overseas for a variety of reasons. It is not possible to identify each and every country to which your personal information may be sent. If your personal information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your personal information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your personal information is mishandled in that jurisdiction. Removing your information

You may request for your information to be deleted at any time by visiting our website at 4MySay.online and following the prompts.  Once your details are deleted, they will be stored in an archives database for 90 days in case we need to retrieve the information for any reason.  After 90 days, the details will be automatically deleted.  Please note that to regain entry to any 4MySay.onlinevenue which you have requested deletion from will require you to fully enrol again.

 

Accessing your information

You may request access to the personal information we hold about you by sending a written request to our Privacy Officer. You do not need to provide a reason for your request. Once our Privacy Officer has verified your identity, we will provide you with a print-out of information we hold about you within 14 days.  Generally, we do not charge any fees for providing access; however, fees may be charged in special circumstances on a cost-recovery basis.

In rare circumstances, and only where it is permitted under the Privacy Act, we may not be able to provide you with access to your information.  This may occur where, for example, we are required by law to withhold the information, it relates to legal proceedings or would affect negotiations we are holding with you.  If we are unable to provide you with access, we will provide reasons for this and consider whether the use of an intermediary would be appropriate to provide you with an explanation of your personal information.

 

Correcting your information

The information and results gathered by 4MySay.online are subject to copyright laws. The media are welcome to quote any statistical information which is freely displayed on 4MySay.online and the App. Should any of this information be used by any media reporting organisation, the organisation must quote the source of the information being 4MySay, prior to releasing the statistics. This applies to media reporting information via Television, Radio, Newspapers, Interviews or any other electronic medium.

4MySay has applied for Patents covering the format of the Site, its operations, and the way the Site gathers and distributes information. If YOU are a commercial entity, you undertake and acknowledge that no part of this site and App and its operations and marketing cannot be reproduced unless specific written permission has been given by 4MySay Pty Ltd.

 

13. Media Questions

 

  1. 4MySay may distribute questions originating from a third-party media operative. Those questions will be sent to registered users' phones at a certain time in the day and close at a specified time. The existing User or Subscriber can participate but has no obligation to respond to those media questions. By downloading the 4MySay App, you agree to receive the media questions, which may be daily.

 

  1. For users that subscribe to 4MySay after being prompted by the third-party media operative, You agree to receive questions from 4MySay directly, sent to phones at 8.30 am each weekday,(Except public holidays). You can delete the App at any time through the profile settings within the App.
